Street Legal in USA?

I´ve found that the latest Cagiva Mito 125 is not legal for street use in the USA (as stated on Cagiva´s web site), but some older/used models have been advertised as street legal. If this is correct, what was the last model year that the 125 Mito was street legal in the USA? Thanks.
